I found out recently that it is illegal to sell or buy hash, so my question to some of the experts out there is this. If it is illegal how can they sell it in clinics, dispensaries, collectives, etc. And what is the penalty in California?

Hash isn't illegal concentrates are written into the sb420 law. Some cities may claim it is illegal though.

I heard it was illegal or something of that nature. I think there is a lot of confusion about this. Do you know why it is regarded differently? And or why this rumor continues?

One stipulation in the law is that with certain types of hash such as honey oil, butane hash oil, etc. the process of making them is illegal, but it's not illegal for clubs to sell them. Also I've heard certain prescription providers don't cover hash and therefore patients have gotten in trouble simply because they thought they could have concentrates when they weren't allowed to. Bubbakush is right that it's written into SB 420.

I saw a recent episode of cops that was filmed in San Bernadino County. According to the arresting officer on the show, hash is illegal in their county and also, their county doesn't recognize MJ to be legal either, regardless of a medicinal state card.I'd stay away from it all together and avoid any trouble or bad association with MJ and Hash users.

About a month ago, in Roseville, CA (outside Sacramento), a young man blew up a storage unit making hash with butane. The whole scenario sounded somewhat strange, like why was he in a storage facility, how did he cause so much damage, etc). If I understand it correctly, using butane to make hash is treated like a meth lab by law enforcement. The thing is, it's hard to make a lot of hash using this method. With a can of butane you can make a gram of hash oil (little more or less), and it takes about 30 minutes or so. I might be wrong, but I think law enforcement is concerned with people using mass quantities of butane, which is dangerous, but to the best of me knowledge, there's no mass production method with butane. I have seen a few Youtube vids with large scale butane extraction methods, but everyone I know does it the "1 can atta time" method.

I guess the large quantities of butane use could be disturbing. I think it's a good idea to check out the legal code on this one. Hate to get in trouble over a little honey hash oil. Or any hash related products for that matter.

Hash is mentioned in prop 215, but it is a heavier punishment if you're caught outside the bounds of the dispensary system.

Hash is a Felony for those with out a doctors recommendation. If you were not a MMJ patient and you got busted with weed you would be issued a ticket with a fine to pay. Just like a traffic ticket. If you got busted with hash you would be charged with a felony...Hash is a drug NOT in its natural form...its concentrated with intent to be more potent and therefor a felony. But like the other person said...concentrates are written into SB420...
Thats funny...I live in Riverside...essentially San Burnadino County...Im on the border of Riverside County and San Burnadino County...The police recognize MJ to be legal. They don't have a choice...its the law, if they resist they run the risk of being sued by every person who ever had to suffer due to false arrest. In the begging there was some confusion as to how to confirm patient identifications. Thats why the state ID card program was developed. Law enforcement could verify via a website the state set up. Now most 420 Doctors have that service built in to their programs...State ID cards are voluntary and I believe useless...

I had a boss at a clinic who made it with an illegal machine and he was able to make about 50 grams at a time. He had this huge setup in the bathroom with this big glass extractor machine. He called the hash Amber Glass and sold it to people for 70 a gram. It was extremely potent, and people would buy it all the time. It was only after I left there that I realized what he was making and selling was illegal. I know that hash made by extracting butane has been made illegal because it is an extremely harmful chemical and is not seen as a natural concentrate. You might as well just inhale a Bic.

I have always thought it was illegal, but if you have a medical marijuana card it is legal for your to purchase

This is kinda confusin to me. Hash is sold at the dispensaries and i am pretty sure it is listed on the 420 bill. So how can some places say it is illegal and others say no. If they would all just legalize it all then we wouldn't have these stupid questions to think about when we are havin a hard time concentrating anyway.

A friend of mine was just arrested a couple weeks ago for hash, and they charged him for a controlled substance. So around here I guess it's worse than getting caught with MJ. And Around here a card will do you no good.

I know that a lot of clinics here have completely stopped selling hash. I only know of a few that still have it and the quality isn't there. There certainly aren't any more places with oils, and a lot of the places have only kiefs or dry hashes. I'm sorry to hear about your friend being arrested, I hope that the punishment isn't too harsh for being caught with hash in New York.

It probably is pretty harsh. New York is not the most 420-friendly of places.

It seems like hash is getting harder and harder to find. There is only one clinic by me that even sells the wax type concentrates, and they ask that the members do not share this information with non-members. Places are taking more precautions and who can blame them, with entire cities banning them and shops being closed every day? I miss having hash so readily available, but I appreciate that clinics are trying to take measures to stick around, and be there for the patients that trust in them.

Seems like most of the dispensaries in the Bay Area still sell concentrates, including hash.
